Allahabad High Court: In the instant case which relates to misappropriation of funds and mal-practices done by elected representatives and higher level of bureaucrats in collusion with investigating agencies in different districts of state of Uttar Pradesh (U.P.) such as Balrampur, Gonda, Mahoba, Sonbhadra, Sant Kabir Nagar, Mirzapur, Kushinagar under the Mahatma Gandhi National Rural Employment Guarantee Act, 2005 (Act), the division bench of Devi Prasad Singh and Ashok Pal Singh JJ., while highlighting that corruption is the main hurdle in effective implementation of the schemes under the Act, issued mandamus directing the Central Bureau of Investigation (CBI) to investigate the abuse of power and misappropriation of funds in the aforesaid districts of U.P.  under the Act and to hold a preliminary enquiry regarding the same in other districts of U.P.  The Court further issued a mandamus to State Government for establishment of multi-member State Quality Monitor Body at district and State level to supervise utilization of funds under the Act and also directed the state government to provide all necessary assistance including manpower within a month to CBI for conducting the aforesaid investigation.
