National Consumer Disputes Redressal Commission (NCDRC): On account of delay in lodging FIR and intimation to Insurance Company, NCDRC has dismissed a revision petition filed by the petitioner whose tractor was stolen and his insurance claim was rejected by the insurance company. Earlier the petitioner was denied relief by District Forum as well as Punjab State Consumer Commission. The petitioner had contended in complaint that his tractor which was insured with Bajaj Allianz General Insurance Co. Ltd. was stolen along with trolley on 5.1.2008. FIR in the matter was lodged on 15.1.2008 and intimation was also given to the Insurance Company. The petitioner had alleged that as the claim was not settled by the Insurance Company, alleging deficiency on the part of Insurance Company, he filed complaint before District Forum. In its defence, Insurance Company submitted that tractor was insured to cover risk of third party for agriculture purpose only and no premium was paid to recover risk of theft or own damage and tractor was not insured comprehensively. It further submitted that trolley was also not covered in the policy. District Forum dismissed the said complaint and appeal filed by the petitioner was also dismissed by the State Commission. In revision, NCDRC observed that as FIR of the theft was registered ten days after the incident and there was also delay in intimating the insurance company, revision was fit to be dismissed at admission stage.
