Constitution (One Hundred and Second Amendment) Act, 2018 notified

The Constitution (One Hundred and Second Amendment) Act, 2018 received the assent of the President and was notified on 11-08-2018. This Amendment is about giving “constitutional status” to National Commission on Backward Classes.

The proposed commission will have a chairperson, vice- chairperson and 3 other members and hear the grievances of socially and educationally backward classes, a function discharged so far by the Scheduled Castes commission.

In order to safeguard the interests of the socially and educationally backward classes more effectively, it is proposed to create a National Commission for Backward Classes with constitutional status at par with the National Commission for Scheduled Castes and the National Commission for Scheduled Tribes.

The National Commission for Backward Classes (Repeal) Act, 2018 (No. 24 of 2018), has also been notified w.e.f. 15-08-2018, to repeal the existing National Commission for Backward Classes (NCBC) Act, 1993. The members that a provision will be made in the rules to include one woman member in the Commission. The powers of the States in respect of OBCs Commission will in no way be curtailed. Giving constitutional status to the OBC Commission will empower it to hear grievances and their redressal. The present Commission lacked powers on these fronts.
